INTRODUCTION
These Terms and Conditions (“Terms”) govern your use of the website located at www.redtagpropertymitigation.com and the services provided by RedTag Property Mitigation, a division of Highly Favored Contractors Inc. (“RedTag,” “we,” “us,” or “our”), a California Licensed General Contractor holding CSLB License #1130391, fully licensed, bonded, and insured, operating primarily in Modesto, California and the surrounding Central Valley service area.
By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
1. SERVICES
1.1 Scope of Services
RedTag Property Mitigation provides commercial and residential emergency property mitigation services, including but not limited to:
– Commercial water mitigation and structural drying
– Fire, smoke, and soot mitigation
– Mold mitigation support
– Storm and emergency mitigation
– Contents and asset protection
– Biohazard and trauma scene cleaning
All services are performed in accordance with IICRC S500 Water Damage Restoration Standards, IICRC S520 Mold Remediation Standards, and all applicable California regulations and contractor licensing requirements.
1.2 Service Area
RedTag Property Mitigation primarily serves Modesto, California and the greater Central Valley region, including Stockton, Tracy, Fresno, Merced, Turlock, Ceres, and surrounding areas. Selective services are available in parts of the Bay Area including San Jose and Oakland. Service availability is subject to capacity and geographic feasibility at the time of request.
1.3 Emergency Services
RedTag provides 24 hours a day, 7 days a week emergency dispatch for active property loss situations. Emergency response times are dependent on location, availability, and conditions at the time of dispatch. Response time estimates provided are not guaranteed and may vary.
1.4 Estimates and Scopes
Any estimate, scope of work, or project assessment provided by RedTag is based on conditions observed at the time of inspection. Additional damage discovered during the course of mitigation work may require scope revisions. RedTag will communicate any material changes to the scope of work and associated costs before proceeding where reasonably practicable.
2. CONTRACTOR LICENSING AND COMPLIANCE
RedTag Property Mitigation operates under California Contractor State License Board (CSLB) License Number 1130391 as a licensed General Building Contractor in the State of California. All work is performed in compliance with California contractor licensing requirements, applicable building codes, and IICRC industry standards.
RedTag holds current general liability insurance and contractor bonding as required by California law. Proof of licensing, bonding, and insurance is available upon request.
3. CLIENT RESPONSIBILITIES
By engaging our services, you agree to:
– Provide accurate and complete information regarding the property, the nature of the damage, and any known hazards
– Grant RedTag and its personnel reasonable access to the affected property to perform assessment and mitigation services
– Notify RedTag promptly of any changes in conditions, access restrictions, or other factors that may affect the performance of services
– Cooperate with RedTag in communicating with your insurance carrier and adjuster where applicable
– Ensure that any required permits, approvals, or notifications to third parties are obtained prior to or during the performance of services where required by law
– Not interfere with or modify any equipment, containment systems, or mitigation measures installed by RedTag without prior written consent
4. INSURANCE CLAIMS AND DOCUMENTATION
4.1 Insurance Coordination
RedTag provides insurance-aligned documentation including Xactimate scopes, drying logs, moisture reading records, equipment placement records, and photo documentation to support your insurance claim. We communicate directly with your insurance carrier and adjuster upon your authorization.
RedTag does not guarantee the outcome of any insurance claim. Claim approval, coverage determination, and payment decisions are made solely by your insurance carrier. RedTag is not responsible for any denial, reduction, or delay of insurance coverage.
4.2 Documentation Accuracy
All documentation prepared by RedTag reflects conditions as observed and recorded during the course of the mitigation project. RedTag uses industry-standard equipment and methods for moisture measurement, thermal imaging, and damage documentation. Documentation is prepared in good faith and in accordance with IICRC standards.
4.3 Client Authorization
By engaging our services, you authorize RedTag to communicate with your insurance carrier, independent adjuster, and other parties involved in your claim on matters directly related to the mitigation scope and documentation.
5. PAYMENT TERMS
5.1 Payment Responsibility
Unless otherwise agreed in writing, the client is responsible for payment of all services rendered by RedTag. Insurance coverage does not relieve the client of responsibility for payment. If your insurer does not cover the full cost of services, you remain responsible for any outstanding balance.
5.2 Invoicing
Invoices are issued upon completion of services or at agreed project milestones. Payment is due within 30 days of invoice date unless otherwise agreed in writing.
5.3 Late Payment
Accounts not paid within 30 days of the invoice date may be subject to a late payment fee of 1.5 percent per month on the outstanding balance, or the maximum rate permitted by California law, whichever is less.
5.4 Disputed Invoices
If you dispute any portion of an invoice, you must notify RedTag in writing within 14 days of the invoice date, specifying the nature of the dispute. Undisputed portions of the invoice remain due and payable by the original due date.
5.5 Collections
RedTag reserves the right to pursue collection of unpaid balances through all available legal remedies, including the filing of a mechanics lien against the property in accordance with California Civil Code requirements.
6. LIMITATION OF LIABILITY
6.1 Service Limitations
RedTag provides mitigation services to stabilize and limit property damage. We do not guarantee the prevention of all damage, mold growth, structural failure, or other consequences arising from a property loss event. The outcome of mitigation services depends on many factors outside RedTag’s control, including the extent and duration of damage prior to our engagement, the cooperation of all parties, and environmental conditions.
6.2 Consequential Damages
To the maximum extent permitted by California law, RedTag shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or these Terms, including but not limited to loss of business income, loss of use of property, or any other economic loss, even if RedTag has been advised of the possibility of such damages.
6.3 Liability Cap
RedTag’s total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you to RedTag for the specific services giving rise to the claim.
6.4 Pre-Existing Conditions
RedTag is not responsible for pre-existing damage, defects, or conditions present at the property prior to our engagement, including but not limited to pre-existing mold, structural deficiencies, plumbing failures, or code violations.
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless RedTag, its parent company Highly Favored Contractors Inc., its officers, employees, subcontractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorney fees, arising out of or related to:
– Your use of our website or services
– Your breach of these Terms
– Your negligence or willful misconduct
– Any inaccurate or incomplete information you provide to RedTag
– Any third-party claims arising from your property or the conditions thereon
8. BIOHAZARD AND SPECIALTY SERVICES
8.1 Biohazard Services
Biohazard and trauma scene cleaning services are performed in compliance with California Department of Public Health regulations, applicable OSHA standards, and all federal and state requirements governing the handling, transportation, and disposal of regulated biological waste.
All biohazard waste is disposed of through licensed regulated waste disposal facilities. Disposal manifests and regulatory compliance documentation are provided upon request.
8.2 Mold Mitigation
Mold mitigation services are performed in accordance with IICRC S520 standards. RedTag provides mitigation support services and coordinates with third-party industrial hygienists for post-remediation clearance testing. RedTag does not conduct clearance testing and is not responsible for the results of third-party clearance testing.
8.3 Structural Stabilization
Temporary shoring and structural stabilization work is performed by or under the supervision of licensed general contractor personnel. Engineer-approved shoring installations require coordination with a licensed structural engineer. RedTag coordinates engineer involvement where required and does not provide engineering services directly.
9. WEBSITE USE
9.1 Permitted Use
You may use our website for lawful purposes only. You agree not to use our website to transmit any unlawful, harmful, or offensive content, to attempt to gain unauthorized access to any system or data, or to interfere with the operation of our website.
9.2 Intellectual Property
All content on our website, including text, images, logos, graphics, and service descriptions, is the property of RedTag Property Mitigation or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.
9.3 Website Availability
We make reasonable efforts to maintain our website and ensure it is available at all times. However, we do not guarantee uninterrupted access and are not liable for any downtime, errors, or interruptions.
9.4 Accuracy of Information

10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
10.2 Jurisdiction
Any legal action or proceeding arising out of or related to these Terms or our services shall be brought exclusively in the state or federal courts located in Stanislaus County, California. You consent to the personal jurisdiction of such courts.
10.3 Dispute Resolution
Before initiating any legal action, you agree to contact RedTag in good faith to attempt to resolve the dispute informally. Please send written notice of your dispute to info@redtagpropertymitigation.com. We will attempt to resolve the dispute within 30 days of receiving written notice.
10.4 Contractor Licensing Complaints
Complaints regarding licensed contractor activities may be filed with the California Contractors State License Board (CSLB) at www.cslb.ca.gov or by calling 800-321-CSLB (2752).
11. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with a revised effective date. Your continued use of our website or services following the posting of changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
12. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
13. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RedTag Property Mitigation regarding your use of our website and services, and supersede all prior agreements, understandings, and representations.
